Protecting a trademark in Israel

How trademark registration works in Israel, what the examiner looks at, and how to extend protection abroad.

Why register

A registered trademark gives its owner the exclusive right to use the mark for the goods and services it is registered for, and a straightforward basis for acting against anyone who uses an identical or similar mark. Relying only on use of an unregistered brand is possible in some cases, but it is harder to prove and to enforce.

Search first

Before launching a name or logo, a search of the trademark register shows whether identical or similar marks are already registered or pending for related goods and services. A search is far cheaper than rebranding after a dispute.

The application

Trademark applications in Israel are filed with the Trademarks Department of the Israel Patent Office. The application identifies the owner, shows the mark and lists the goods and services it will cover, grouped according to the international classification of goods and services. The list should be broad enough to protect the business, and accurate enough to avoid objections.

Examination

An examiner checks whether the mark is distinctive, whether it is merely descriptive of the goods or services, and whether it conflicts with earlier marks. If there are objections, the examiner issues a report and the applicant can respond with arguments, amendments or evidence of use.

Publication and opposition

Once the application is accepted, it is published, and anyone who believes the mark should not be registered can file an opposition within three months. If there is no opposition, or the opposition fails, the mark is registered.

Renewal

An Israeli trademark registration lasts ten years and can be renewed for further periods of ten years. Missing a renewal can mean losing the registration, so renewal dates should be tracked.

Protection abroad

Israel is a member of the Madrid Protocol. On the basis of an Israeli application or registration, the owner can file one international application designating the other member countries where protection is needed, instead of filing separately in each country.
